Transferring LPG into recreational cylinders

The technical safety authority issues permits for filling recreational gas cylinders with a capacity of no more than 5 kg.

Self-employed or company engaged in LPG transferring activities

A recreational cylinder is an LPG cylinder with a capacity of no more than 5 kg, used for providing fuel for recreational purposes (cooking, heating, lighting). LPG may be decanted with decanting equipment that has:

Decanting may commence if the person doing the decanting has conducted a preliminary examination and is satisfied that the recreational cylinder is in suitable condition, the cylinder and its valve are undamaged, and the cylinder has had a valid periodic inspection.

If the cylinder or its accessories do not meet the technical and safety requirements, the decanting request will be denied.

The Budapest or county government office acting as the technical safety authority will issue a permit to a LPG retailer where:

The permit request shall specify the location where the activity is to be carried out.

The authority shall prohibit unlicensed decanting and, in case of repeated offences, impose a fine.

The decanting permit shall be revoked if:

  1. the conditions for issuing the permit are no longer met (see ‘What to do’),
  2. the activity is performed by anyone other than the person with the required licenses, or
  3. the authorised user has not had the periodic technical and safety inspection every year for the decanting equipment.

The administrative time limit is 60 days.

The following shall be attached to the decanting permit request:

  1. the documents certifying the availability of the LPG exchange station management permit, the license for handling LPG decanting and filling equipment, and the fire safety permit,
  2. the contract with a term of at least one year with an LPG distributor, and
  3. the technical instructions regarding the decanting, and the workplace risk assessment prepared by the occupational safety expert relating to the technical inspection of the equipment and the method.

The licensing procedure fee is HUF 55 000.

No appeal may be made against the merits of the authority’s decision. If you do not agree with the authority’s decision, you may submit an application to bring an administrative lawsuit based on an infringement of the law within 30 days of receipt of the decision. The application must be addressed to the competent court with territorial jurisdiction, and submitted electronically to the Budapest or county government office acting as the technical safety authority.

If the authority fails to pass a decision by the prescribed time limit, the client may commence the activity.
