Announcement on change of address (registered place of domicile, place of residence)

A citizen residing in the territory of Hungary and subject to the personal data and address register is obliged to announce their address of place of domicile for the purpose of registration. The address of the place of residence can be announced (announcement of place of domicile or residence hereinafter referred to as: announcement of address) or must be announced as a condition of entitlement under Section 26/A of Act LXVI of 1992 on the registration of personal data and address of citizens. In the context of a moving, announcement must be made within 3 working days of the date of the moving in or out. 

If the citizen has announced their place of residence, the citizen is obliged to announce the termination of place of residence.

The address announcement can be issued by electronic means if

Providing only the settlement (city) of the address in the personal data and address register is not possible in electronic means.

If the announcement is not made as an accommodation provider (e.g. owner or beneficial owner), a statement or deed suitable for proving the entitlement of any other form must be attached to the application. If the address announcement is made electronically, only one PDF file (with a maximum size limit of 2 MB) certified by the AVDH (Identification Based Document Authentication) service can be enclosed, which can contain the consent of several co-owners or beneficial owners, if necessary.

If you announce your address electronically, you must identify yourself using one of the following identification channels provided by the Authentication Services:

In the case of electronic administration, after entering your personal identifier, you must complete the electronic form. Only an address registered as valid in the personal data and address register and selectable from the drop-down address list can be announced as a home address. It is not possible to enter a postal code, which will be assigned to the address during the announcement procedure.

Once you have completed the form, you can submit your application for the procedure to be commenced. You can receive the Official Verification Card of the Personal Identifier and Address (address card) containing your new address in person or by post.

The following documents are required for announcing the address by personal appearance:

In certain circumstances, you might need additional documents (e.g. power of attorney, rental agreement) as well.

At an electronic point of administration, the announcement of address can be completed if:

• You are the sole owner or sole beneficial owner of the flat/property;

• As accommodation provider, the owner or sole beneficial owner of the flat/property has consented electronically to the announcement of address in advance or via the Client Settings Register.

The citizen can announce their address only in respect of themselves.

The citizen must complete the electronic form at the electronic point of administration. Only the address can be announced, which is a valid address in the personal data and address register and can be selected from the address list.

Once the form has been completed and formally checked, the application can be submitted and the procedure started. The citizen will receive new address card containing their new address in person/ by representative or by post – at their choice.

Deadlines for the client:

If the address is announced in the context of a moving, the announcement must be made within 3 working days of the date of the moving in or out.

Deadlines for the authority:

If the application is complete and the facts of the case are clarified based on the data available, the administrative time limit is 8 days, otherwise the deadline is 60 days. If the announcement is made in person either at a district (capital district) office (Document Bureau, Government Office) or to the municipal clerk competent for the new address, in the case of complete application and clarified facts, the new address is usually entered in the personal data and address register immediately and a new address card is also issued on site.

For a procedure by personal appearance, the ”Lakcímbejelentő lap” (Address Registration Form - in hard copy) can be obtained free of charge at the clerk or at any district (capital district) office (Document Bureau or Government Office).

The procedure is free of charge.

District (capital district) offices. In the case of an address announcement made to the municipal clerk competent for the new address, the address card is issued and handed over or served to the client by the district (capital district) office competent for the client's place of domicile or place of residence.

Any district office can be selected as the acting authority for an electronic announcement procedure and at electronic point of administration; it is the district office indicated in the application which will act on the case.

The activities of the district (capital district) offices and the clerk are supervised by the capital and county government offices.

During the procedure, an administrative court action can be initiated by a statement of claim. The statement of claim must be submitted to the acting district office or clerk electronically, by post or by personal appearance within 30 days of notification of the decision.

Place of domicile of the citizen: the address of that flat or accommodation (hereinafter referred to as: flat), which serves as a basis for the citizen’s official relations with the State and with natural and legal persons and organisations without legal personality, as well as their the residence-related rights and obligations.

Place of residence of the citizen: the address of the flat where the person resides for more than three months without the intentding to change residence.

Address data of the citizen: the address of the citizen’s place of domicile or place of residence (hereinafter jointly referred to as: address).

Legislation may require the announcement of place of residence or other proof of normal residence as a condition for the exercise of a right, the use of services, the fulfilment of an obligation or other legal effect. 

Unless legislation – in respect of a right or obligation -  otherwise provise, the citizen’s place of domicile shall be considered as normal residence if no announcement of place of residence has been made.A citizen who changes the address may either act on their own behalf or by their statutory representative or proxy.

The announcement of the address of a minor child or a person under custodianship fully limiting capacity to act shall be made by their parent (one parent is sufficient) or their custodian (legal representative).

A minor child over the age of 14 may act on their own behalf to announce their place of residence.

In a procedure by personal appearance, the following persons are entitled to announce the address:

 

Consent by the accommodation provider:

A consent of the accommodation provider is required for the announcement of the address, with the exception specified by law.

The accommodation provider is a person (e.g. owner, beneficial owner, manager of a commercial accommodation) entitled to provide a flat or other premises for housing for a natural person.

No consent of the accommodation provider is required if the citizen has a valid private or public deed of full probative value (e.g. a rental agreement) entitling them to use the flat. The document must be submitted to the acting authority.

The accommodation provider gives the consent required for the registration of the address either with their own handwritten signature on the address application form or electronically. The consent of the accommodation provider can be made electronically in advance or via the Client Settings Register.

In the case of joint ownership, the consent of the co-owners is confirmed by a written statement of the accommodation provider acting during the address announcement. The written statement must be submitted to the acting authority.

Returning an invalid address card:

An address card of a previous address is invalidated by the acting authority and a new address card is issued. In the case of a procedure by personal appearance, the invalid address card must be returned to the acting district office simultaneously with the announcement.

Recording of address data on an identity card (eSzemélyi):

Provided at the time of the announcement you possess an identity card with a storage element (chip), if announcing in person, you must hand over the card to the competent authority for the announced address data to be registered on the storage element. The competent authority will return the identity card with the storage element to you immediately after the address data have been recorded.

If announcing electronically and at electronic point of administration, the announced address data are recorded on the storage element subsequently, which can be requested by personal appearance at any district office.

Multilingual standard form:

The multilingual standard form provided for in Regulation (EU) 2016/1191 of the European Parliament and of the Council may be applied for simultaneously with the official certificate for personal identification number and official address card, in order to eliminate language barriers and thus further facilitate the use of the official certificate between the Member States.

The sole purpose of multilingual standard forms is to facilitate the translation of the official certificate for personal identification number and official address card, thus such forms cannot be transmitted as separate legal documents between the Member States.
